Osborne pays creditors, fights IRS goes to taxes

Jennings Osborne, the millionaire Little Rock philanthropist famed for having thousands of points of light at his home and elsewhere, emerged from bankruptcy this week by arranging quick payments to his creditors -- except the Internal Revenue Service.
Osborne and his wife, Mitzi, filed for bankruptcy protection in July 1995 after negotiations with the IRS broke down. The agency filed a lien on their property the preceding January.
He will pay the IRS $10,000 a month, until the claims are settled. The IRS says Osborne owes $3.5 million in interest, taxes and penalties.
Osborne gave his first in-depth interview Thursday on why a family reporting $183,500 a month in income filed bankruptcy. He said IRS liens and threats of seizure put him and his business, Arkansas Research Medical Testing Center, in a bind. Osborne's business tries out new pharmaceuticals on volunteer subjects.
For Osborne, the bankruptcy "gave me time to catch my breath. They had a lien on everything we own and had it so we could not sell assets. We were between a rock and a hard place."
He said Thursday he has been audited by the IRS " 17 years in a row," then wondered aloud how scrutiny like that missed the $3.5 million the agency claims now Osborne now owes. In early 1995, the IRS issued a lien of $361,118.28. By November, the lien had escalated to $ 1,720,859.96. Now the IRS says Osborne owes $3.5 million.
A regional spokesman for the IRS did not return telephone messages Thursday afternoon. Federal law prohibits the agency from discussing personal cases.
"Filing bankruptcy was the most embarrassing thing of my life," Osborne said. "That night, CBS (television) called and said they were going to" broadcast news of the bankruptcy during the University of Arkansas' NCAA Championship finals "unless I gave an interview."
With the bankruptcy behind him, Osborne no longer has to report his money habits to the court. Osborne said he is "going to Disneyworld." Trips and other expenditures have required court approval since he filed for bankruptcy in July 1995. The Florida theme park accepted his famous Christmas lights after the state Supreme Court told him the crowds drawn to the annual display were clogging traffc. Osborne said he was leaving for Florida with his family today.
U.S. Bankruptcy Judge James G. Mixon signed Osborne's agreement Tuesday.
According to the agreement, Osborne had already paid Fairfield Communities Inc. the $860,712.75 his company owed on its Little Rock building. He had paid First Commercial
Bank in Little Rock $200,000 on each of two loans, and agreed to pay the remaining balance in 12 months. These mortgages for Osborne's home, its lot, two adjacent ones on Robinwood Drive in Little Rock and a second home in Hot Springs totaled $1,572,356.66.
Another $226,157.92 was paid to other creditors, including $97,931.50 to settle some ofthe older IRS claims. As for the current claims, Osborne has agreed to pay $ 10,000 a month to the IRS until the claims are resolved. The IRS will pay back any surplus after the case is resolved.
Osborne said the IRS's claim was "90 percent fluff." The IRS was the only claim Osborne disputed in the bankruptcy case.
"Seldom one sees a bankruptcy in which someone does not lose," said Robert Lowry of Little Rock, an attorney for Osborne.
All creditors who were not paid immediately will receive 10 percent interest, the agreement shows. The disputed IRS claim and a related state Department of Finance and Administration claim will be fully paid when the court resolves the claims, according to the agreement.
Don't look for those claims to be resolved soon, Lowry said. There will be "a great deal of discovery motions made and depositions taken," he said.
Under federal law, IRS agents cannot be forced to give depositions in tax court. The IRS lien and threats of seizure "was the predicating reason for the filing," Lowry said, but declined to comment further.
"It has never bothered me to play hardball in my life, especially when dealing with someone who has acted wrongfully," Lowry said. The IRS case file on his client "is Alice in Wonderland, Franz Kaflca or Dr. Seuss, I know not which," Lowry said.
Osborne said his troubles began with the IRS audits. He was audited every year, but each audit would be for a tax filing two or three years before, Osborne said. "So when they found something, they could attach interest and penalties," he said. "They could turn $100 into thousands that way.
"I've paid the IRS millions of dollars, and never complained, but I didn't get where I am today by ignoring things," Osborne said. He said he demanded that the IRS get current on the audits, he said, and the row began, escalating with each step.
The difference between his tax dispute and every other, Osborne said, is that "the Lord has blessed me with the means to fight it."

The premiums were awarded to 4-H Club and Future Farmers of America members who showed prize-winning market animals in judging events held earlier in the week at the Arkansas State Fair. The five grand champions -- a steer, market hog, lamb, pen of broilers and turkey -- brought $35,950 in premiums to five Arkansas youngsters. Affiliated Foods Southwest provided a record $16,200 in premiums to Ginger Crossland, 15, of E1 Dorado (Union County), who showed the grand champion steer, a 1,285-pound exotic crossbreed steer. Affiliated Foods Southwest also paid $4,000 in premiums to Chelsea McDowell, 12, of Hatfield (Polk County), for the grand champion lamb, a 114-pound Suffolk lamb. This marks the second consecutive year that Chelsea has shown the grand champion lamb. Maggie Keener, 16, of Hatfield (Polk County) received $8,000 from Volume Services, the official food service vendor for the Arkansas State Fair, for her grand champion market hog, a 242 pound Hampshire barrow. The Arkansas Poultry Federation paid $4,150 in premiums to Eric Wright, 14, of Quitman (Cleburne County) for his grand champion pen of broilers. The Jannings Osborne family paid $3,600 in premiums to Lance Wright, 18, of Quitman (Cleburne County) for his grand champion turkey. The reserve grand champion steer shown by Tonya Madewell, 15, of Prairie Grove (Washington County) brought $ 10,100 from the Arkansas Farm Bureau. | Paper Trails Date: 10/24/96 Category: STYLE Page: E Carrie Rengers The jammin' judges play for Arkansas If you ever have to appear before Arkansas Supreme Court Associate Justice David Newbern or Pulaski County Circuit Judge David Bogard, you might find they look familiar. Perhaps that's because you've seen Bogard jamming at Juanita's or Newbern sitting in with the Arkansas Symphony Orchestra. "I'm kind of a folk singer," Newbern says. "A real folk singer is someone who would be classified as a member of the folk. I'm too opulent for that, I guess." Newbern, who plays the tuba, banjo and mandolin among other instruments, was the first administrator of the Ozark Folk Center when it opened in 1973. He now plays with The Ozark Point Brass Quintet and the Little Rock Wind Symphony. "Come to think of it, I guess there are a couple of others," Newbern says of his musical associations. Bogard, who began his musical life on the trombone and now plays instruments such as the piano, fiddle and auto harp, is a past president of the Arkansas Blues Connection. "They kept trying to put on a blues concert, and finally I kind of spearheaded the whole thing," Bogard says. Although he's still well known in music circles -- "In fact, I sent to the penitentiary a guy who used to play at Juanita's all the time" -- Bogard is no longer associated with the blues society. "I guess I just burned out of it," Bogard says. "It's like a part-time job." Newbern agrees, "It's really hard for me to squeeze it all in." He'd love to play music full time, but Newbern says, "I'm not that talented." But he couldn't be that bad, since he took his guitar on the campaign trail and strummed his way to the Supreme Court in 1985. Bogard these days hopes to produce some computer-generated arrangements. "You don't have a band but it sounds like it." Newbern and Bogard have played together, too. One concert included former Supreme Court Justice Darrell Hickman. When Bogard introduced the trio, he said, "I'm not Diana Ross but these two are the Supremes." Hickman, who "was so scared the first night he could hardly even hit the strings," according to Bogard, reportedly is now on a motorcycle tour of the country. Bogard and Newbern, however, plan to keep their day jobs. Home for sale As many Arkansans already know, Jerry Van Dyke is leaving California for life as a Razorback. One of the stars of the long-running "Coach," Van Dyke is selling his suburban Toluca Lake estate so he and his wife, Shirley, can spend more time on their 500-acre cattle ranch at Malvern. His San Fernando Valley estate is listed at $2.7 million. Built for Bing Crosby in 1936, the California home was damaged by fire in 1943 and an earthquake in 1994. It was refurbished each time. Van Dyke bought the home from Andy Griff'th in 1993. An expensive Thanksgiving City folks who don't understand the livestock portion of the Arkansas State Fair and Livestock Show might have left the fair last weekend thinking Jennings Osborne had just bought himself a $3,700 turkey for Thanksgiving. It was a beautiful honeysuckle white turkey, but the price tag seemed a bit high even by Osborne standards. Turns out Osborne never even saw the turkey and probably never will. "Maybe they'll take a picture of it for me," says Osborne, who will have to buy another turkey if he wants to eat one this Thanksgiving. "It's just a donation. It helps the children." Individuals and businesses give money to kids who raise and show prize-winning animals. For instance, the grand champion steer brought one hard-working girl $16,000. Fair offcials hope kids use their earnings for education, but they don't have to. Osborne's almost $4,000 this year actually bought him a pen of three turkeys. In past years, he says, "I think I purchased a couple of cows and (a) bull. I don't know." Osborne says, "I would love to have a $3,000 turkey -- with a Tiffany necklace! Nothing's too outlandish for me." Doughnut donations In other purchases, those reports about Osborne buying off IRS and other government offcials just aren't true. Osborne sends doughnuts every Monday to various places --one regular shipment is to the state Capitol -- because "I figure people need to be jump-started once in a while." He says, "It's nice to do it on a Monday morning." Occupants of the Federal Building were treated this week, but Osborne says he wasn't trying to curry favor with judges or anyone else. He also notes that the IRS, with which Osborne has had a few problems, is in the building next door and did not receive a sugary shipment. A second shower a day The state Insurance Department's new downtown Little Rock building has a feature that most government buildings don't: a shower. "It was just part of the remodeling that was done," says Commissioner Lee Douglass. The shower is located near his off'ce on the building's third floor, but Douglass says he didn't request it nor has he used it. Anne Laidlaw, leasing administrator with state Building Services, says a group of administrators, whose off'ces also are on the third floor, requested that a janitorial area be converted into a shower. "It would be handy to have a shower there because they do have some folks who like to jog on their lunch hour," Laidlaw says. A few other state agencies have little-used showers in their buildings, most of which are for field workers who have a reason to get particularly dirty during the day. The Atkins Building, however, has a shower that no one wants. It was in the building when the Arkansas Department of Community Punishment and the Post Prison Transfer Board moved in, but the agencies hoped for a toilet in that particular spot instead. "Unfortunately, it wasn't set for a commode so they ended up with just a shower," Laidlaw says. The Associated Press contributed to this report. |

In addition to lighted spooks, young visitors can collect goodies as they wander the pumpkin patch. The animals are still the star attraction, but haunting lights and aspooky forest add to the fun at Boo at the Zoo. I love Halloween. The smell of wood fires, the sight of children dressed in plastic copies of latest fads. Among my most memorable Halloweens were the ones when I dressed as the Bride of Frankenstein (I still have a big-hair phobia that I attribute directly to all the teasing and spraying my mother did that night, not to mention the combing out later), the time I was a yellow Crayola crayon and the Haunted Hayride I worked on as a high school senior. The hayride was the best -- nearly three weeks of running around a mock graveyard on the fringe of New Jersey's Pine Barrens. The most frightening moment for me (and everybody else) was when I slipped in the mud and was pulled under the wagon. Despite the bruises running from my right foot up to my left shoulder, I loved the job. Times have changed. Many of today's parents, unfamiliar with their neighbors and all too familiar with urban legends of sociopaths poisoning candy or kidnapping precious Power Rangers and Pocahontases, are reluctant to let their children go house to house trick or treating. But they don't want to spoil one of the most enjoyable nights of the year for the kids. Where do they take the little ghosts and goblins? Coming to the rescue are various groups hosting Halloween-themed activities around the state. Here are a few: O The Ace of Clubs House, 420 Pine St., Texarkana, is being transformed from its usual identity as a stately old home into a regular Gallery of Horrors, 6-8 p.m. Saturday. The old Victorian-era mansion's dry moat will be filled with nonthreatening spooks (they don't touch the spookees) in haunting scenes. They're even featuring a scene based on Edgar Allan Poe's "Masque of the Red Death." Unfortunately, stairs make the gallery inaccessible to wheelchairs. Activities in addition to the gallery include a cakewalk, a storyteller and gypsy fortuneteller. Admission is $2, (903) 793-4831. Five Little Rock museums have joined the Aerospace Education Center/ MAX Theater and the River Market merchants for the second annual Big BOO!-seum Bash. This year, kids have a chance to win a Game Boy if they get a game card stamped at three or more of the participating sites. At the Arkansas Territorial Restoration, trick-or-treaters will have to go knocking on the doors of historic houses to get their goodies. Wandering the grounds will be a green-faced witch straight out of a fairy tale, ready to tell a few tales of her own, as well as a mad scientist stirring up potions. Though the Old State House is closed for renovation, the staff didn't want to be left out of this year's party, so they're setting up at Trapnall Hall, 423 E. Capitol. Inside the Civil War medical tent, children's fingers will be put in casts, just like they had broken a bone. For apple bobbing with a twist, the apples will be suspended in the air. Also on hand will be Mr. Trapnall, telling stories from his time. Kids can score some candy for their bags and popcorn to munch while at the hall. It's Dia de Muertos over at the Arkansas Museum of Science and History, 503 E. Ninth St. The Day of the Dead celebration, inspired by the traditions of Mexico, will include the making of death masks and skeleton bread. The Arkansas Arts Center will offer candy, restaurant coupons and more to their trick-ortreaters, along with the opportunity to make a ghoulish collage pin from such materials as tissue paper and glitter. A haunted house geared to the younger set, intended to be creepy but not scary, will be the focal point at the Children's Museum of Arkansas, 1400 W. Markham St. In addition, there will be crafts to make ghost prints and three-dimensional construction paper pumpkins, plus a bean bag toss for free passes to the museum. The Aerospace Education Center won't be showing any IMAX films on Halloween, but they will have an astronaut posing for photos and a ghostly Charles Lindbergh telling the story of his frightening solo journey across the Atlantic Ocean. Games and treats will be the attraction at the River Market, 400 E. Markham. The museums, except Trapnall Hall, and the River Market will be open from 4:30 to 8 p.m. Thursday. Trapnall Hall will open at 5 p.m. Adults must be accompanied by children. Organizers expect visitors will spend between 20 to 30 minutes at each site, though they welcome dawdlers. Free admission. Free shuttle buses will run between the locations. Call 324-9351. In Van Buren, the Old Town Merchants association brings Halloween on Main Street on Saturday in the form of a children's parade for masqueraders 12 and under at 5:30 p.m., followed by a costume contest. Train and pony rides will be available, as well as game booths and candy for trick or treaters. At 6 p.m., the haunted house beckons. Among last year's scares were a cannibal and a scene based on Anne Rice's vampire stories. The horrors in store for visitors to the house are a closely guarded secret so far this year. Bernie Manard, a reformed cannibal and committee chairman, reminds those planning to haunt Main Street on Saturday that the candy is usually gone in the first half hour to 45 minutes. He doesn't recommend those in wheelchairs to attempt to navigate the haunted house. Admission to the haunted house is $ 1. Call 474-0510. Virtually all kids love animals, especially when they have the chance to collect candy and other treats while visiting them. Boo at the Zoo adds another enticement with Halloween lights from the Jennings Osborne family. Wandering through the Little Rock Zoo, visitors can expect such curiosities as a talking forest and a pumpkin patch. On the Elephant Stage, zoo docents will present "Creatures of the Night," an educational show featuring owls and opossums, along with other nocturnal creatures. Despite the "cats, bats and boneyards," Friends of the Zoo spokesman Kathy Taylor claims not even the youngest child will be too frightened to enjoy the spooky atmosphere. Hours: 6-8:30 p.m. through Thursday. Admission: $2, $3 children, $1 less for Friends of the Zoo. Call 666-2287. The Museum of Black Arkansans, 12th and Louisiana streets, has rounded up high school volunteers to stage a Haunted Cathedral of terrorizing exhibits, including "Children of the Corn" and "Texas Chainsaw Massacre" inspired scenes. Hours: 7-10 p.m. today-Wednesday, 7 p.m.-midnight Thursday. In conjunction with the cathedral, EMOBA has planned hayrides around downtown cemeteries and past points of historical interest, with cemetery workers on board sharing their favorite spine-tingling stories. Hayrides will pick up at the Haunted Cathedral today and Thursday, with additional dates as announced. Admission to the cathedral is $4 and the hayride is $2, or pay $5 for both.
